Main 10 points of Consumer Protection Act, 2019

1.        E-Commerce

Companies like Paytm, Amazon, Flipkart, Snapdeal etc.
Have to declare compulsorily about
Return and Refund Policy
Complaints should be REGISTERED and
SOLVED within ONE MONTH time

2.        Misleading Advertisement

           Make party to Stars and celebrities who promote the product
Liability of stars, celebrities and promotion content creators will be fixed for misleading ads and Reviews

3.        Telecom & Food

Can sue against Telecom and Food services like Zomato and Swiggy etc.

4.        Manufacturer Liability 

Manufacturer is also liable for problem in product

5.        Aggregator Liability

Like manufacturer, Aggregator Selling Platform Provider will also be liable

6.        Jurisdiction of consumer forum

Place of filing of consumer complaint. Now consumer can file the complaint in their own city. Now this sentence is worthless "All disputes are subject to "specific city" jurisdiction only.

7.        E-Filing

No need to go to consumer forum office, just file it online from your place.

8.        New Limit of consumer forum

PECUNIARY JURISDICTION :

District :             Up to 1 Crore, ||
State :    1 Crore to 10 Crore ||
National :           Above 10 Crore

9.        50% Compensation

Submission Before Higher Appeal
In case of compensation order by district or any lower forum, service provider can only appeal by depositing 50% of compensation amount in court.

10.      ESI, PF Liable

Now consumer can go to consumer forum against government agencies also like ESI and Provident Fund.

उपभोक्ता संरक्षण अधिनियम 2019 के मुख्य 10 बिंदु

1.        ई कॉमर्स व्यवसाय | E-Commerce

ई कॉमर्स वेबसाइट जैसे Paytm, Amazon, Flipkart, Snapdeal इत्यादि को अब अनिवार्य रूप से अपनी रिटर्न एवं पैसा वापसी की पालिसी घोषित करनी होगी और शिकायत को पंजीकृत करते हुए एक महीने के अन्दर समाधान करना होगा.

2.        भ्रामक विज्ञापन | Misleading Advertisement

अब उपभोक्ता भ्रामक विज्ञापन करने वाले उसे प्रमोट करने वाले सेलिब्रिटी को भी मुक़दमे में पार्टी बना सकता है, झूठा विज्ञापन करने या राय देने पर इनका भी उत्तरदायित्व तय होगा.

3.        टेलिकॉम एवं खाद्य सेवाओं में | Telecom & Food

अब टेलिकॉम मोबाइल एवं खाद्य सेवाओं जैसे zometo, swiggy जैसी सेवाओं को भी इस अधिनियम के क्षेत्र में ले लिया गया है.

4.        वस्तु निर्माता का उत्तरदायित्त्व | Manufacturer Liability 

यदि वस्तु में कोई खराबी है तो बेचने वाले के साथ साथ उसके निर्माता की भी जिम्मेदारी तय होगी.

5.        समूहक का उत्तरदायित्व | Aggregator Liability

विक्रय का प्लेटफोर्म जैसे ई कॉमर्स वेबसाइट इत्यादि उपलब्ध करने वाले की भी जिम्मेदारी तय होगी.

6.        उपभोक्ता फोरम का क्षेत्र निर्धारण | Jurisdiction of consumer forum

अभी तक सेवा देने वाला या वस्तु बेचने वाला शर्तों के अंत में यह उल्लेख कर देता था कि "All disputes are subject to ‘specific city’ jurisdiction only”, इसमें उपभोक्ता को कठिनाई होती थी, लेकिन अब उपभोक्ता अपने स्थान पर ही मुकदमा कर सकता है.

7.        ऑनलाइन शिकायत | E-Filing Complaint Online

पहले उपभोक्ता को उपभोक्ता फोरम के कार्यालय जा कर शिकायत करनी पड़ती थी परन्तु अब कार्यालय जाने की आवश्यकता नहीं शिकायत ऑनलाइन ही दर्ज करा सकते हैं.

8.        आर्थिक सीमा फोरम की | New Limit of consumer forum

आर्थिक अधिकार क्षेत्र :

जिला  :     Up to 1 Crore, ||राज्य :      1 Crore to 10 Crore ||राष्ट्रीय :     Above 10 Crore

9.        50% क्षतिपूर्ति जमा करना  | 50% Compensation

पहले बड़ी कंपनियां क्षतिपूर्ति का आदेश लोअर कोर्ट / फोरम से होजाने पर अपर फोरम में अपील करके वाद को स्थगित करवा लेटी थीं परन्तु अब अपर फोरम में अपील करने से पहले उन्हें क्षतिपूर्ति की आदेशित धनराशी का 50% कोर्ट में जमा करवाना अनिवार्य हो गया है .

10.      ई एस आई तथा पी ऍफ़ की भी जिम्मेदारी | ESI, PF Liable?

अब सरकारी संस्थाओं जैसे ई एस आई तथा प्रोविडेंट फण्ड जैसे कार्यालय भी उपभोक्ता  फोरम के क्षेत्र में उत्तरदायी हो गए हैं
