The Supreme Court has directed the state government to clear the salary arrears of Patna High Court judge, Justice Rudra Prakash Mishra, which have been pending for the past 10 months.
A bench comprising Principal Chief Justice DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra questioned how a judge could be expected to work without receiving a salary. The court mandated that the state government must pay all outstanding salaries and dues from the date they became due. Additionally, the court instructed the opening of a temporary General Provident Fund (GPF) account for Justice Mishra.
The delay in salary payments was attributed to the absence of a GPF account for Justice Mishra, who was appointed to the High Court on November 4 of the previous year. His lawyer informed the court that since his appointment, Justice Mishra had not received his salary due to the lack of a GPF account. During the hearing, Solicitor General Tushar Mehta assured the court that the issue would be resolved promptly. However, the court emphasized the necessity of opening a temporary GPF account and ensuring that all pending salaries and dues are paid without further delay.
